Information from Round One:

6-27-2014 Schedule of Public Hearings with MoPSC is announced.  Please plan on attending – the more supporters present, the better case we make to block Grain Belt Express.  We have been informed that there will now only be one meeting in each county.  Four meetings will occur at 11:00 am.  Four meetings will occur at 5:00 pm.

If you need special accommodations for a disability call the Public Service Commission’s Hotline at 1-800-392-4211 (voice) or Relay Missouri at 711 before the hearing.

Grain Belt is required to print notices in the newspaper ads in the affected counties 10 days prior to the scheduled hearing meeting.

6-26-2014 – We are hard at work developing testimony, fulfilling Grain Belt data requests and preparing data requests of our own.  Follow the case  using the instructions above to see the flurry of activity.

We have reached our current fund raising goal.  At this point we seem to be financially sound.  Thank you for these important contributions.  We may need additional funds down the road.  We hope we can count on your continued financial support if and when we may need it.

6-23-2014 – The dates of Public Meetings with the PSC have not yet been determined.  However, we were informed that there will be two meetings in each of the eight affected counties.

We need your participation.  One meeting will be in the daytime and the other at night.  Please plan on attending these meetings.  We understand that everyone in attendance should have an opportunity to speak.

The dates will be posted as soon as we are advised by the MoPSC.

5-15-2014MoPSC Staff files a very encouraging response to the  Eastern MLA/Show-Me Concerned Citizens request for hearings.

One of many of their reasons to hold the hearings and public meetings was Item 5 on Page 2 – “A plethora of comments have been filed in this case in the Commission’s electronic filing and information system, most opposing Grain Belt Express Clean Line LLC’s application.”

5-15-2014MLA files support for Eastern MLA/Show-Me Concerned Citizens request for hearings.  Attached is an Affidavit worth reading.

5-14-2014 – United for Missouri (UFM) filed for Intervention on April 24, 2014.  UFM stated in its application that its interest in this matter “relates to land property rights and the ability of property owners in the state to exercise their land property rights in a free economy” and that it opposes any entity using the power of eminent domain for private purposes.

On May 2, 2014, Grain Belt filed its opposition to UFM’s application to intervene stating “UFM does not have a valid interest in the matter because its interest is no different from that of the general public and it has no legal rights which will be affected, directly or indirectly, by the Commission’s decision. Grain Belt argues that the exercise of eminent domain is well-settled law and any general opposition to that policy should be raised with the General Assembly.”

Today, the MoPSC granted UFM’s application for intervention citing “It has been the Commission’s practice to liberally grant intervention to organizations that promote various public policy positions in order to consider a full range of views before reaching a decision.”

5-13-2014 – Office of Public Counsel Supports motion by Eastern MLA’s Show-me Concerned Citizens asking for a Pretrial Hearing Conference as well as Local Public Meetings.  THIS IS GOOD NEWS!

The Office concludes that due to over 3,000 letters received by the PSC Staff, and the fact there are 20 intervening parties, this is a “contested case”.  They found that it is “unlikely that a Staff recommendation will bring about agreement between the parties on the issues in this case.”  Hopefully the commissioners will take this recommendation seriously and schedule the hearing and public meetings.

Thank you so much for your letters to the PSC – keep them coming.  If and when the public hearings get scheduled, it is VERY IMPORTANT that we attend and make our voices heard.  We hope to see you there.  This is our chance to speak directly with the commissioners.*
